Terms of Service

These terms cover your use of PerformerPages, a website builder for performers operated by HEARD Digital Marketing in Denver, Colorado ("PerformerPages," "we," "us"). By creating an account or buying a plan, you agree to them.
1. Who can use PerformerPages
You must be at least 18 to create an account and buy a plan. A parent or legal guardian may create an account and build a site for a performer under 18. The account holder is responsible for everything on the account, including content about the performer. We don't knowingly collect personal information directly from children under 13.
2. Your account
Keep your login details private. You're responsible for activity on your account. Tell us right away at hello@performerpages.com if you think someone else has accessed it.
3. Plans and billing
Prices are listed on our pricing page and are charged in US dollars through Stripe.
Do It Yourself is billed yearly, or monthly with no minimum term.
Do It With Me, We Do It For You and Custom Design have a one time setup fee plus a monthly fee with a 12 month minimum term.
Plans renew automatically at the end of each term until you cancel. Yearly plans renew yearly. Paid tier plans continue month to month after the first 12 months.
We may change prices with at least 30 days notice by email. Changes apply at your next renewal.
4. Cancellation and refunds
You can cancel anytime from your billing page.
Do It Yourself monthly plans end at the close of the current month.
Yearly plans and paid tier plans run through the end of their current term. If you cancel a paid tier plan during the first 12 months, the remaining monthly fees for that term are still due.
Setup fees cover work that starts right away and are not refundable once work begins.
We don't give refunds for partial months or unused time, except where the law requires it.
5. Failed payments
If a payment fails, we'll email you and your site stays live for 7 days. If it's still unpaid after that, your site goes offline. Your content stays saved, and your site comes back as soon as the balance is paid.
6. Done for you services
For We Do It For You and Custom Design, we build your site from the materials you send us. We Do It For You includes up to two update requests a month. Unused requests don't carry over. Custom Design gives you a design made for you, but the code, templates and platform stay ours.
7. Your content
You own everything you upload: photos, videos, resumes, bios and anything else. You give us permission to store, display, format and share that content as needed to run your site and the service. That permission ends when you delete the content or close your account, except for backups we keep for a short time.
You confirm you have the right to use everything you upload, including photos taken by photographers and video or audio that includes other people's work. Get permission from your photographer before posting their photos, and credit them where they ask.
8. What you can't do
Don't use PerformerPages to post content that's illegal, sexually explicit, hateful, harassing, or that infringes someone else's rights. Don't post anyone's home address or private contact details. Don't try to break, overload or get around the security of the service. We can remove content or suspend accounts that break these rules.
9. Copyright complaints
If you believe content on a PerformerPages site infringes your copyright, email hello@performerpages.com with the page address, the work you own, and your contact details. We'll review it and remove infringing content.
10. Our service
We work to keep sites online and fast, but we can't promise the service will never have errors or downtime. We may update features, templates and the editor over time. Keep your own copies of your photos, videos and resume.
11. Ending your account
You can close your account anytime. We can suspend or close an account that breaks these terms or doesn't pay. After an account closes, you can ask us to export your content for 30 days. After that we may delete it.
12. Limits on our liability
PerformerPages is provided "as is." To the extent the law allows, we aren't liable for indirect or lost profit damages, and our total liability for any claim is limited to what you paid us in the 12 months before the claim. We can't guarantee auditions, bookings, casting results or admissions.
13. Governing law
These terms are governed by Colorado law. Any dispute will be handled in the state or federal courts in Denver, Colorado.
14. Changes to these terms
If we make important changes, we'll email account holders at least 30 days before they take effect. Using the service after that means you accept the updated terms.
